This document outlines the specific terms governing the "Unsolicited Offers" feature available on the Carloom Automotive (Pty) Ltd Platform (carloom.co.za). By utilizing this feature, both Buyers and Dealerships agree to the following conditions, which are supplementary to our main Website User Terms and Conditions and Privacy Policy.
1. Purpose of Unsolicited Offers
The "Unsolicited Offers" feature is designed solely to allow a Buyer to express a preliminary, non-binding indication of interest in a vehicle at a price point different from its listed price. It serves as a passive communication channel for a Buyer to convey a potential interest to a Dealership.
2. Nature of the Offer
Not a Formal Offer to Purchase: Any submission made through the "Unsolicited Offers" feature by a Buyer is expressly understood not to be a formal offer, bid, or contractual proposal to purchase the vehicle. It is a purely unsolicited expression of interest.
No Binding Obligation on Buyer: The Buyer submitting an unsolicited offer is under no firm commitment or legal obligation to purchase the vehicle at the proposed price, or at all. This feature does not create any contract or agreement between the Buyer and Carloom Automotive (Pty) Ltd, or between the Buyer and the Dealership.
No Binding Obligation on Dealership: The Dealership receiving an unsolicited offer is under no obligation whatsoever to accept, respond to, acknowledge, or engage in any form of negotiation based on such an offer. The Dealership retains full discretion over whether or not to act upon any unsolicited offer.
3. Carloom Automotive (Pty) Ltd's Role
Carloom Automotive (Pty) Ltd acts solely as a facilitator for the transmission of this unsolicited expression of interest from the Buyer to the Dealership.
Carloom Automotive (Pty) Ltd is not involved in, nor responsible for, any subsequent direct communication, negotiation, or potential transaction that may or may not arise between the Buyer and the Dealership as a result of an unsolicited offer.
Carloom Automotive (Pty) Ltd does not endorse, verify, or guarantee the sincerity, financial capability, or intent of any Buyer submitting an unsolicited offer.
4. Dealership Discretion
Dealerships acknowledge that the receipt of an unsolicited offer does not alter the listed price of their vehicle, nor does it impose any duty to consider, counter, or respond to the Buyer. Dealerships are free to continue marketing and selling their vehicles at their discretion, irrespective of any unsolicited offers received.
5. No Expectation of Response or Outcome
Buyers using this feature explicitly acknowledge and agree that there is no expectation or guarantee of any response from the Dealership. The decision to engage with an unsolicited offer rests entirely with the Dealership.
6. Misuse of the Feature
Any misuse of the "Unsolicited Offers" feature, including but not limited to submitting frivolous, fraudulent, or harassing offers, may result in the suspension or termination of the User's account on the Carloom Automotive (Pty) Ltd Platform, as per our main Website User Terms and Conditions.
7. Acceptance
By using the "Unsolicited Offers" feature, you confirm your understanding and acceptance of these specific terms, along with the broader Carloom Automotive (Pty) Ltd Website User Terms and Conditions and Privacy Policy.
